Staff Report & Agenda Item Details

Pursuant to Section 826.017 of the Texas Health and Safety Code, the City Council is required to designate an officer to act as the local rabies control authority for purposes of the Rabies Control Act of 1981 (the "Act"). Pursuant to the Act, the local rabies control authority shall enforce: the Act and the Department of State Health Services's rules that comprise the minimum standards for rabies control; the ordinances and rules of the City; and the rules adopted by the executive commissioner of the Health and Human Services Commission under the area rabies quarantine provisions of the Act. This item allows Council to designate the person holding the position of Deputy Chief of Police as the Local Rabies Control Authority. Additionally, this item appoints the Deputy Chief of Police to the Animal Shelter Advisory Committee. This appointment is necessary, in order to fill a vacancy on the committee created by the retirement of Captain Lauersdorf. The committee is composed of five members, who serve three-year terms. The committee assists the City in complying with the requirements of the state law pertaining to animal shelters and performs other duties delegated to it by the City Council.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 2.9/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
