Staff Report & Agenda Item Details

The City of Denison periodically encounters residential structures that are substandard, unsafe, or otherwise unfit for human habitation. These conditions may involve occupied dwellings where residents must temporarily vacate the premises, as well as vacant structures requiring repair, rehabilitation, securing, or demolition. The policy establishes a graduated approach that prioritizes voluntary compliance, repair, and rehabilitation before demolition is considered. To promote consistency and interdepartmental coordination, the policy establishes a Case Review Committee to evaluate significant substandard structure cases and consider factors such as the condition of the property, imminent danger, rehabilitation feasibility, available assistance programs, relocation needs, and whether demolition is appropriate. Overall, the proposed policy provides staff with a clear and consistent process for addressing substandard structures while preserving safe housing whenever feasible, protecting displaced residents, and ensuring that enforcement and public resources are administered in accordance with applicable law.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 2.8/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
