Staff Report & Agenda Item Details

On May 4, 2026, SiEnergy Gas, LLC (“SiEnergy” or “Company”) filed with the City a Statement of Intent to change gas rates within the incorporated areas served by SiEnergy and a notice of its intent to consolidate its operations and assets with the other members of SiEnergy Holding, LLC. In the filing, the Company asserted that it is entitled to a $4 million increase within its incorporated areas or a 31.4% increase over current adjusted revenues, excluding gas costs. In May, the Cities Served by SiEnergy (“Cities”) engaged the services of consultants to review the Company’s filing. The consultants identified numerous unreasonable expenses and proposed significant reductions to the Company’s request. Accordingly, Cities’ attorneys recommend that all Cities members adopt the Resolution denying the rate change. Once the Resolution is adopted, SiEnergy will have 30 days to appeal the decision to the Railroad Commission of Texas (“RRC”) where the appeal will be consolidated with SiEnergy’s filing for the environs and those cities that have relinquished their jurisdiction currently pending at the RRC (i.e. Case No. OS-26-00031317). Under the law, cities with original jurisdiction over this matter have 125 days from the initial filing to take final action on the Company’s application. By the agreement of the parties, this deadline was suspended until September 4, 2026. As such, all cities, including the City of Mansfield, Texas, with original jurisdiction, will need to adopt the Resolution no later than September 4. The purpose of the Resolution is to deny the rate application proposed by SiEnergy as stated above.
