Staff Report & Agenda Item Details

This request is for a zone change for a residential property located at 2412 Paint Rock Rd. This property has been speculated for development for many years; the challenge is the flood plain and foodway encompasses a significant portion of the property. Therefore, the property owner is seeking a rezoning from the slightly larger lots of RS-1, being a minimum of 5000 Sq. Ft. and a 50' frontage per lot to a smaller frontage of 35' and smaller lot size being 2,100 Sq. Ft. The applicant would like to do Zero Lot line housing, which is a single-family-style house just placed on one property line with a required 10' setback for building separation on the adjacent lot. This is in the designated infill area and the property owner wants to maximize the usable lot space on the property. This style of housing is reflected as a need from our 2019 and 2024 Resintel study and these areas close to Goodfellow allow for entry-level housing at a more affordable rate. There were discussions from the adjacent neighborhood with concerns about traffic. The adjacent local roads are designed to accommodate the volume fo traffic along with speed limits and appropriate designations for bus stops to minimize pedestrian vehicular interactions. The Planning Commission heard the case on August 17th and made a recommendation of approval with a 6-0 vote.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 6.7/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
