Staff Report & Agenda Item Details

The City of Rowlett, alongside 181 other Mid-Texas cities, is a member of the Atmos Cities Steering Committee (ACSC). On August 14, 2026, Atmos Pipeline - Texas (APT, a division of Atmos Energy Corporation) filed its 2026 Rider REV annual rate adjustment with the Railroad Commission of Texas under Case No. 00032632. The adjustment decreases system-wide rates by ($164,012,478), which translates to a monthly capacity charge decrease of ($4.02123) per MMBtu of MDQ for City Gate Service (Rate CGS) and ($3.46819) per MMBtu of MDQ for Pipeline Transportation Service (Rate PT). The adjusted rates will be effective on November 1, 2026, and expire on October 31, 2027. While ACSC legal counsel Thomas Brocato has communicated that no formal municipal action is legally required to implement this decrease under APT's original tariff, adopting this Resolution is highly recommended to formally approve the rate reduction, document the benefits to our local residents, and establish clear regulatory tracking for municipal gas utility files.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 2.9/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
