Staff Report & Agenda Item Details

This is a appeal of the decision by the Planning Commission to revoke a conditional use for a short-term rental. In the Zoning Ordinance Section 406.D.6.iii & iv: Violation: : Failure to timely report and remit hotel tax & hotel tax report reflects no reported revenue without prior written notice to the Planning Department that they have temporarily ceased operations. The AirBnB listing is attached and documents how many stays per month. From July–August 2025, under the previous owner, there were at least 6 documented stays. From September 2025-present under the new owner, there were at least 16 documented stays. Planning It appears there was a sale of the property and the new owners did not follow through with payment of Hotel Occupancy Taxes in a timely manner. They have since come into compliance. City staff recommended revocation to the Planning Commission. They agreed by a 6-0 vote. City Staff have gained additional information and would propose that if City Council wants to reinstate the Conditional Use, then we have the following condition: 1. They must provide proof to City staff of all stays and hotel occupancy taxes submitted for the time period of September 1, 2026–February 28, 2027, on or before March 10th, 2027
