WASTEWATER TREATMENT AGREEMENT The board discussed a draft wastewater treatment agreement with Fountainhead MUD for service to the proposed Orchid Homes project. Revisions requested by Fountainhead include a substantial capital recovery fee, and ongoing monthly service charges at 120% of Fountainhead’s in- district rates. After discussion, upon motion by Mr. Whisler, seconded by Mr. Armand, and unanimously carried, the board authorized an inquiry of the other Bammel wastewater treatment plant participants as to whether they have surplus capacity that could be made available to the District, an update of the potential developer reimbursement calculations for the project by the District’s financial advisor, and submission of Fountainhead’s proposed terms to the Orchid Homes project developer to be sure that they want to proceed.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 5.0/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
