WASTEWATER TREATMENT AGREEMENT Director Whisler reported as to his findings on review of the sewer service expense documentation provided by Fountainhead MUD as requested at the special meeting with their board on April 30, 2025. Mr. Whisler's primary concern is that the contract language needs to make clear that Bammel's share of costs for major repairs will not be billed to Bammel in addition to the monthly service fee if those costs are included in calculation of the monthly service fee. Mark W. Brooks of Young & Brooks, the attorneys for the District, had previously distributed proposed revisions to the contract language that Mr. Whistler is recommending to address his concerns. After review and discussion, upon motion by Mr. Whisler, seconded by Mr. Armand, and unanimously carried, the board approved the proposed Wastewater Treatment Agreement with Fountainhead MUD subject to the revisions recommended by Mr. Whisler. 4
