6.N. Approve Resolution of the Board Regarding Wage Payments During Emergency School Closings Description: During an emergency closure (such as we had a couple of weeks ago due to the weather), all employees shall continue to be paid for their regular duty schedule unless otherwise provided by Board action. Following an emergency closure, the Board shall adopt a resolution or take other Board action establishing the purpose and parameters for such payments. (Board Policy DEA LOCAL) To overcome a challenge that such a payment is a gift of public funds, the board should adopt such a resolution or take similar action at an open meeting that complies with the Texas Open Meetings Act. The resolution or action should address: the public purpose served by continuing wage payments; which employees will continue to receive wage payments; if applicable, whether nonexempt employees who will be required to work while the school is closed will receive premium payments; and the duration of the payments, which can be revisited if the district is required to remain closed for longer than anticipated.
