Staff Report & Agenda Item Details

The applicant requests approval of a Special Use Permit (SUP) to allow an accessory structure exceeding 500 square feet on property zoned Single Family (SF-40) District. Section 77-303 of the Rowlett Development Code (RDC) requires approval of a Special Use Permit for accessory structures exceeding 500 square feet in residential zoning districts.

It should be taken into consideration that a building permit was issued on October 29, 2025, for the accessory structure, which was subsequently constructed without prior approval of a Special Use Permit. Based on resident queries, it was determined that the accessory structure exceeds the maximum size permitted by right and approval of a SUP is required to bring the property into conformance.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 7.3/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
