Staff Report & Agenda Item Details

Discussion and possible action on alleged violations by Edwin Hatcher/McKinley Drilling Co., including but not limited to appropriate penalties and/or other enforcement remedies to be imposed and/or pursued in court. - Initial motion by Director Schuehle; seconded by Director Miranda: EE Water Company, LLC, DBA McKinley Drilling Company, and its licensed driller, Edwin Hatcher, violated District Rules 5.3, 5.4, and 6.2 by not filing a Notice of Intent to Drill, by “not drilling” a new well for non-exempt use without a Drilling Permit, by failing to meet spacing requirements, and by failing to register the well. Having considered each of the factors in District Rule 9.5(b), the Board would assess a penalty of $3,000, payable to the District within 15 days. If the penalty is not paid on time, a lawsuit would be filed under the District’s enforcement authority to enforce the judgment and to pursue all costs and fees under Section 36.102 of the Water Code. Amendment by Director Raetzsch; seconded by Director Clark: Remove the word “not” so the motion reads “by drilling a new well for non-exempt use without a drilling permit,” for a typo correction. Final motion: EE Water Company, LLC, DBA McKinley Drilling Company, and its licensed driller, Edwin Hatcher, violated District Rules 5.3, 5.4, and 6.2 by not filing a Notice of Intent to Drill, by drilling a new well for non-exempt use without a Drilling Permit, by failing to meet spacing requirements, and by failing
