Staff Report & Agenda Item Details

1. Section 2 of the Contract is hereby amended to include the following: “c. The price per gallon will be calculated once per year in accordance with this paragraph and will be determined by taking the twelve month average of low sulfur diesel fuel in the Gulf Coast area listed on https://www.eia.gov/petroleum/gasdiesel as of the date Texas Pride Disposal is preparing the Customer’s monthly invoice, rounded down to the nearest $0.25, (the “Annual Average Fuel Price”) to determine a Fuel Recovery Fee Percentage. The Fuel Recovery Fee Percentage shall equal 1.0% if the Annual Average Fuel Price equals $3.25 per gallon plus 1.0% per every $0.25 that the Annual Average Fuel Price is over $3.25 per gallon. For example, an Annual Average Fuel Price of $3.25 = 1%, $3.50 = 2%, $3.75 = 3%, and so on; provided, however, and notwithstanding anything to the contrary herein, the Fuel Recovery Fee Percentage shall be capped at and never exceed 8.00%. The Fuel Recovery Fee on the Customer’s monthly invoice shall be determined by multiplying the total amount invoiced to the Customer for garbage and recycling collection that month times the applicable Fuel Recovery Fee Percentage, rounded down to the nearest $0.01. When the Annual Average Fuel Price falls to less than $3.25 per gallon, there shall no longer be a Fuel Recovery Fee charged to the Customer for the following twelve-month period. Texas Pride Disposal shall attach to each invoice that includes a Fuel Recovery Fee documentation supporting its calculation of such fee. Texas Pride Disposal shall also provide to the Customer any additional information regarding the Texas Pride Disposal’s calcula
