7. Discuss potential pink letter waiver and take appropriate action. Mr. Wilson recognized Ms. Cook, who discussed a resident’s request to have the $50 delinquency waived. She noted that in February the resident was waiting for the results of a leak adjustment and was told that the account would be protected from disconnection. She stated that SE later notified the resident that her adjustments were completed on her account and provided the resident a new total for payment. She noted that the resident didn’t pay the updated amount and therefor received the delinquency fee. Mr. Smith noted that SE followed the District’s delinquent process. Ms. Cook stated that the resident is requesting the waiver as SE didn’t specifically instruct the resident to pay the updated amount. Mr. Wilson noted that the Board cannot make case by case waiver decisions, and that if the waiver is granted, then the Rate Order would need to be revised to include a one-time exemption for all residents. Upon motion by Director Randall, seconded by Director Boards, after full discussion and the question being put to the Board, the Board voted by majority, with Director Maxwell opposing, to not waive the fee, as it was no fault of the District.
