Invitation of citizens or Directors to speak in advance of District’s regular business (limited to 3 minutes each – agenda items/non-agenda items). – Mrs. Baker provided public comment. President Starcke paused the Special Meeting at 6:54 PM to go into executive session (Agenda Item # 5) as permissible under Texas Government Code Section 551.071, Consultation with Attorney – Closed Meeting. The Board came out of executive session and President Starcke resumed the Special Meeting at 7:37 PM. Regarding agenda items # 2-4, President Starcke reviewed the Board’s options under Section 36.102 of the Texas Water Code and Section 9 of the District’s rules. The statute provides for up to $25,000 per violation per day of ongoing violation for a civil penalty if the District pursues enforcement in court. GCGCD rules provide for up to $10,000 per violation per day of an ongoing violation. President Starcke reminded the Board of the factors for consideration.
