Staff Report & Agenda Item Details

These items are a result of many months of meetings with local mobile food vendors and citizens around the community. We are working to be in line with recent state legislation where local jurisdictions no longer conduct the Health permit side of mobile food units and how that impacts the zoning ordinance. We are also addressing some locations in which mobile food units want to serve, particularly in residential areas up to 3 times per year and in local parks with the Park Director's approval. The distance for separation in the ROW for Mobile Food Units from an permanent food establishment is proposed to maintain the 100' distance.

We are removing the requirement for temporary mobile units (3 days or less) to have Design and Historic Review Commission permission in the design districts, unless they are modifying a permanent structure.

Bastiat Liberty & Property Rights Analysis

This motion is scored as EXPANDS_GOVERNMENT (Impact Weight: 7.0/10). Under the Bastiat Liberty Watchdog Index, measures that increase tax rates or fee schedules, issue new debt or Certificates of Obligation, expand regulatory/zoning restrictions on private land use, or authorize unbudgeted spending expansions reduce an official's Freedom Score when voted YES (and reward dissenting NO votes).
