Dr. Bill Hutchinson presented the following: DFC Comparison: e HB 2078 requires demonstration of the achieved DFC. e Aquifer systems recommended classification as not relevant due to no monitoring data or an inadequate model. Bill talked to TWDB and suggested they include the Rustler Aquifer when they do the update of the Edwards Trinity Plateau and Pecos Valley Aquifers. e Presented actual and simulated drawdown by GCD. The Texas House Natural Resources Committee has released its interim charges for the 89th Legislature, focusing on the implementation of recent water laws and the long-term viability of the state's aquifers. Below is a concise update on the key priorities relevant to current groundwater management and technical reporting: Legislative Monitoring (HB 2078 & SB 7) A top priority is monitoring the implementation of HB 2078, which governs the joint planning of Desired Future Conditions (DFCs). This includes a new requirement for Groundwater Conservation Districts (GCDs) to provide clear, “plain language” explanations of how they track DFC achievement and how they have performed over the last five-year cycle. Groundwater Management & Modeling The Committee will study whether current DFCs provide enough protection and if there are significant "impediments" to achieving them. There is a specific call to: Improve Data: Evaluate the need for increased investment in groundwater data and modeling tools (GAMs) to support better decision-making. Large-Scale Production: Assess the authority of districts to address impacts from massive groundwater export projects. Unregulated Areas: Investigate how pumping in unregulated parts of the state impacts the management efforts of established GCDs. Innovative Supply & Brackish Water There is a renewed focus on “New Water" strategies, including: Page 3 of 8 Minutes of 04-21-2026 Brackish Groundwater: Monitoring the designation of production zones and ensuring that the development of brackish aquifers does not compromise existing fresh groundwater resources. Data Centers: For the first time, the Committee will specifically examine the total water usage of data centers, particularly in water-stressed regions, to evaluate potential conservation policies. The Texas House Energy Resources Committee has prioritized the management of water and inactive infrastructure for the upcoming legislative interim. Here is an update on the three key areas of focus:
